Privacy Policy

This policy explains, in plain terms, what personal data GigVia collects from buyers and sellers, why we collect it, who we share it with, and the choices and rights you have over it.

Section 01 · Buyers & Sellers

Introduction & Scope

GigVia is a marketplace that connects buyers, who post gigs, with sellers, who complete them. Running that marketplace means handling personal data responsibly, and this Privacy Policy explains exactly how we do that, at every stage of using GigVia, whether you're posting your first gig or withdrawing your hundredth payment.

This policy applies to every visitor, buyer, and seller who uses gigvia.com, our mobile applications, and any related services we refer to collectively as the "Platform." It works alongside our Terms of Service and Platform Rules, not instead of them. If any term used here isn't defined in this policy, it carries the same meaning given to it in our Terms of Service.

By creating an account or otherwise using GigVia, you acknowledge that your personal data will be collected, used, and shared as described below. If you don't agree with any part of this policy, please don't use the Platform, and reach out to Support with your concerns.

Section 02 · Buyers & Sellers

Information We Collect

We collect information in three ways: what you give us directly, what we gather automatically as you use GigVia, and what we occasionally receive from trusted third parties.

Information you provide to us

  • Account details, such as your name, email address, password, country, and profile photo.
  • Identity and payout information, including documents used for identity verification, and bank, card, or e-wallet details used to fund or withdraw balances.
  • Gig content, such as gig instructions and proof requirements you post as a buyer, and the submissions, files, links, or written proof you provide as a seller.
  • Communications, including messages exchanged with other members, reviews you leave, and correspondence with GigVia Support or the Resolution Center.

Information collected automatically

  • Device and log data, such as your IP address, browser type, operating system, and general device identifiers.
  • Usage data, including pages visited, gigs viewed or claimed, search terms, and the timing and frequency of your activity on the Platform.
  • Approximate location, generally inferred from your IP address, used for currency display, fraud prevention, and regional gig eligibility.

Information from third parties

  • Identity verification providers, who confirm the authenticity of documents you submit without GigVia storing the raw document longer than necessary.
  • Payment processors, who share limited transaction status data needed to fund gigs, release escrow, and process withdrawals.
  • If you sign up or log in through a third-party service, such as Google, that service may share your name, email address, and profile image with us.

How We Use Information

We use the information described above for the following purposes, and we don't use it for purposes incompatible with these without telling you first:

  • To operate the Platform: creating and maintaining your account, matching gigs with sellers, processing escrow, payments, and withdrawals, and displaying the profile and history that other members rely on.
  • To keep GigVia safe: verifying identity where required, detecting fraud, fake completions, or manipulated reviews, and enforcing our Platform Rules and Terms of Service.
  • To communicate with you: sending gig updates, submission and review notifications, security alerts, and responses to Support or Resolution Center requests.
  • To improve the Platform: understanding how gigs are used and completed so we can fix issues, refine matching, and build features members actually need.
  • To meet legal obligations: responding to lawful requests, maintaining tax and financial records, and satisfying anti-fraud and anti-money-laundering requirements tied to payouts.
  • With your consent, to send optional marketing communications about GigVia features or promotions, which you can opt out of at any time.

Legal Basis for Processing

Where privacy laws such as the GDPR require it, we rely on the following legal bases to process your personal data:

  • Contractual necessity — processing needed to create your account, run the escrow and payment system, and deliver the core gig-matching service you signed up for.
  • Legitimate interests — processing that keeps the marketplace trustworthy, such as fraud prevention, dispute investigation, and service improvement, balanced against your rights.
  • Legal obligation — processing required to meet tax, financial, and anti-money-laundering laws that apply to a payments marketplace.
  • Consent — processing you can withdraw at any time, such as optional marketing emails or non-essential cookies.

How We Share Information

GigVia does not sell your personal data. We share it only in the following circumstances, and always under an obligation to protect it:

  • With other members, in the limited way the marketplace requires: buyers see a seller's public profile, completion history, and submitted proof; sellers see a buyer's gig instructions and public rating.
  • With service providers who help us run GigVia, including payment processors, identity verification vendors, cloud hosting providers, and customer support tools, each bound by contract to use your data only for the service they provide us.
  • For legal reasons, when we believe in good faith that disclosure is required to comply with a law, regulation, court order, or valid government request, or to protect the rights, property, or safety of GigVia, our members, or the public.
  • In a business transfer, such as a merger, acquisition, or sale of assets, in which case personal data may be transferred as part of that transaction, subject to the same privacy commitments described here.
  • With your direction, when you explicitly ask us to share your information with a third party, such as connecting a third-party login.
Good to know — Sensitive payout details, such as full bank account or card numbers, are only ever visible to GigVia and our payment processors. Other members never see this information, even during a dispute.
Section 06 · Buyers

Privacy for Buyers (Clients)

As a buyer, your gigs and your funding method involve some data that's specific to how the marketplace works for you:

  • Funding a gig requires sharing payment details with our processor; GigVia itself never stores your full card number.
  • Gig instructions you post are visible to any seller browsing that category, so avoid including sensitive personal or business information you wouldn't want publicly seen until a gig is claimed.
  • Once you approve a submission, the seller who completed it can see your public profile and rating history, the same way you can see theirs.
  • Confidential information you share with a seller during a gig, such as account access or unreleased material, is covered separately under our Platform Rules and should never be requested through channels outside GigVia.
Section 07 · Sellers

Privacy for Sellers (Freelancers)

As a seller, verification and payout are the two areas where GigVia asks for more sensitive information, handled with extra care:

  • Identity verification documents are reviewed to confirm authenticity and are retained only for as long as required for compliance, fraud prevention, or legal purposes.
  • Payout details are used exclusively to process your withdrawals and are shared only with the payment processor handling that transfer.
  • Your public profile shows your completion history and rating to buyers, but never your payout details, verification documents, or full legal name unless you choose to display it.
  • Proof of work you submit is visible to the buyer reviewing that specific gig, and to GigVia Support if a dispute is opened over that submission.

Cookies & Tracking Technologies

GigVia uses cookies and similar technologies to keep the Platform working smoothly and to understand how it's used:

  • Essential cookies keep you signed in, remember your preferences such as theme and currency, and protect against fraudulent activity. These can't be turned off without affecting core functionality.
  • Analytics cookies help us understand aggregate usage patterns, such as which gig categories are most active, so we can improve the Platform over time.
  • Preference cookies remember choices like your notification settings so you don't have to reset them on every visit.
  • You can manage non-essential cookies through your browser settings or the cookie preferences available on the Platform at any time.
Section 09 · Buyers & Sellers

Data Retention

We keep personal data only for as long as it serves the purpose it was collected for:

  • Account and profile data is retained for as long as your account remains active, so the Platform can function as expected.
  • Gig history, submissions, messages, and reviews are generally retained after account closure to preserve the integrity of records for other members involved in the same gigs, and to support any dispute that may still be open.
  • Financial and payout records are retained for the period required by applicable tax and financial regulations, which is often longer than the life of your account.
  • When data is no longer needed for these purposes, we securely delete or anonymize it in line with our internal retention schedules.

Data Security

We apply a layered set of technical and organizational safeguards to protect your personal data:

  • Data is encrypted in transit between your device and our servers, and sensitive fields, such as payout details, are encrypted at rest.
  • Access to personal data internally is restricted to staff who need it to do their jobs, such as Support handling a case you've opened.
  • Payment processing is handled by PCI-compliant processors, meaning GigVia itself never sees or stores your full card details.
  • We continuously monitor for suspicious activity and unauthorized access attempts across the Platform.
Please note — no method of transmission or storage is completely secure. While we work hard to protect your information, we can't guarantee absolute security, and we encourage you to use a strong, unique password and enable any available account protections.
Section 11 · Buyers & Sellers

Your Rights & Choices

Depending on where you live, you may have some or all of the following rights over your personal data. We honor these requests for every member, regardless of location, wherever reasonably possible:

  • Access — request a copy of the personal data we hold about you.
  • Correction — ask us to fix inaccurate or incomplete information, most of which you can also edit directly in your account settings.
  • Deletion — request that we delete your personal data, subject to records we're legally required to keep, such as financial and tax history.
  • Portability — request your data in a structured, commonly used format so you can transfer it elsewhere.
  • Objection & restriction — object to certain processing based on legitimate interests, or ask us to limit how your data is used while a request is reviewed.
  • Withdrawing consent — opt out of marketing communications at any time using the unsubscribe link, or adjust non-essential cookies through your preferences.

To exercise any of these rights, contact GigVia Support. We may need to verify your identity before processing a request, and we'll respond within the timeframe required by applicable law.

Section 12 · Buyers & Sellers

International Data Transfers

GigVia connects buyers and sellers across many countries, which means personal data may be processed in a country other than the one you live in. Where we transfer data internationally, we rely on recognized safeguards, such as standard contractual clauses or equivalent legal mechanisms, to ensure your information continues to receive an appropriate level of protection wherever it's processed.

Children's Privacy

GigVia is not directed at, and is not intended for use by, anyone under the age of 18. We do not knowingly collect personal data from anyone under 18. If we become aware that we've collected data from someone under this age, we will take reasonable steps to delete it. If you believe a child has provided us with personal data, please contact Support so we can investigate and act promptly.

Changes to This Policy & Contact

We may update this Privacy Policy from time to time to reflect changes to our practices, new features, or legal requirements. Material changes are announced by email or in-platform notice with reasonable notice before they take effect. Continuing to use GigVia after that date means you accept the updated policy, so we encourage you to review it periodically.
